User Agreement

Effective from 1st day, December of 2022 year

  1. Introduction

    1. Services

      These terms below ("Terms") apply to all applications, interactive features and services developed, operated and maintained by Chongqing International Communication Center Co., Ltd. (hereinafter the "Operator") for Bridging News (hereinafter the "APP" or the "Bridging News"), all other interactive features, services, and communications provided, operated, and maintained by Bridging News, and all email newsletters published or distributed by Bridging News. When one registers with and starts using the APP, he/she becomes a "Member". If he/she chooses not to register with the APP, he/she may access certain features of the APP as a "Visitor".

    2. Agreement

      This User Agreement for Bridging News (hereinafter the "Agreement") is an agreement between the User (both a member and a visitor) and the Operator to govern the use of the APP by the User. This Agreement, together with all updates, supplements, additional terms, and Bridging News's Privacy Policy collectively constitute these "Terms" between the Users and the Operator. These Terms apply to both Members and Visitors.

      YOU ARE ACCEPTING THESE TERMS AND AGREEING TO ENTER INTO A LEGALLY BINDING AGREEMENT WITH THE OPERATOR (EVEN IF YOU ARE USING ON BEHALF OF A COMPANY OR AN ENTITY) BY YOUR CLICKING ON THE "AGREE" BUTTON IN THE OPEN PAGE OF THE APP. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT CLICK "AGREE", DO NOT USE THE APP AND EXIT IMMEDIATELY. IF YOU WISH TO TERMINATE THIS AGREEMENT, AT ANY TIME YOU CAN DO SO BY CLOSING YOUR ACCOUNT AND NO LONGER ACCESSING OR USING THE APP.

    3. Change

      These Terms may be changed from time to time. If material changes are made to these Terms, the Users will be provided with a notice through the APP, or by other means, to provide the Users the opportunity to review the changes before they become effective.

      It is assumed that no changes to these terms will be retroactive. The User's continued use of the APP after a notice on a change to these terms is made public or is sent to the User means that he/she accepts those changes. Should the User intend to object to any changes, he/she may close his/her account or stop using the APP.

  2. Privacy

    The User is advised to read Bridging News's Privacy Policy(https://bn.ichongqing.info/protocol/privacy.html), which forms an integral part of these "terms", and which describes what data is collected from the Users and their devices (hereinafter the "Data"), how the data is used, and what law it is based on. This policy also describes how the Users' content is processed, such as the content contained in the Users' communications with others; their posts; uploaded, stored, broadcast or shared files, photos, documents, audio, digital works, web live streams, videos, etc. (hereinafter the "Uploaded Content"). Uploaded Content will be processed with the consent of the Users and in accordance with applicable law and permissions. By agreeing to these Terms, the User is perceived as having given consent to the APP's collection, use and disclosure of the Uploaded Content and Data as described in the Privacy Policy. In some cases, separate notices will be issued and requests will be made for the User's consent with reference to the Privacy Policy.

  3. Copyrights and Ownership

    The ownership and copyright of the Uploaded Content will be belong to the uploading User, unless a third party has a claim ownership and/or copyright of the same content.

    The ownership and copyright of other contents, other than the Uploaded Content will belong to the Operator and its affiliates, or to their licensors, vendors, agents and/or their content providers.

    The ownership and copyright of any non-content intellectual property related to the APP owned by the Operator and its affiliates, or with their licensors, vendors, agents and/or their service providers.

    The User hereby agrees that the Operator, its affiliates, their licensors, vendors, agents, and their service providers shall have the right to use the Uploaded Content for the purpose of providing services to the Users or for the purpose of assisting or technically supporting the provision of services to the Users.

    Except as otherwise indicated in specific documents within the APP, or permitted by any applicable local copyright laws:

    1. The User is hereby authorized to view, play, print and download copyrighted content found in the APP for personal, informational, and noncommercial purposes only. Any resale or commercial use of the APP, the Uploaded Content, the contents other than the Uploaded Content is prohibited;

    2. The User shall not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, transfer, sell or create derivative works from any Content contained in the APP;

    3. A prior written permission shall be obtained by the User before he reuses any copyrighted Content that is available in the APP;

    4. Notices of any copyright, or other proprietary rights shall not be removed by the User from the Content in the APP.

  4. Trademarks

    All trademarks, service marks, and trade names of the Operator used herein and contained in the APP (collectively "Marks") are trademarks or registered trademarks of the Operator or its affiliates, partners, vendors, or licensors. They shall not be used, copied, reproduced, republished, uploaded, posted, transmitted, distributed, or modified by the User in any way, especially in advertising, presentation, or promotion, without prior written consent from the Operator.

    The use of the Marks on any other website or APPs is not allowed. It is prohibited to use the Marks as a "hot" link unless the establishment of such links have been approved in advance. The User shall not use the name "Bridging News" in any linguistic presentation, pictures, or symbols which could, in the APP operator's judgment, imply the Operator's endorsement in any (i) written or oral advertising or presentation, or (ii) brochure, newsletter, book, or other written material of whatever nature, without the Operator's prior written consent.

  5. Service Availability

    The Operator may change, suspend or discontinue any part of the APP. It does not guarantee to store or keep showing any content that the User has shared with or submitted to the APP, which is not operated as a storage service. It is agreed that the Operator is not obliged to store, maintain or provide the User with a copy of any content that the Users have provided, except to the extent required by applicable law or otherwise indicated in specific documents within the APP.

    Without prior written consents from the Operator, the User shall not:

    1. Use data mining, robots, or similar tools to gather and extra data from on the APP;

    2. Frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Operator, its content providers or its affiliates;

    3. Use any meta tags or any other "hidden text" utilizing the name or trademarks of the Operator;

    4. Take any action that imposes, or may impose in the sole discretion of the Operator an unreasonable or disproportionately large load on the infrastructure of APP;

    5. Interfere with or attempt to interfere with the proper working of the site or any activities conducted on the APP; or

    6. Bypass any measures that are used to prevent or restrict access to the APP.

    The Operator has the right to suspend or block any access to the APP (or any portion thereof) if any unauthorized use occurs.

  6. Using the APP

    1. Account Registration

      Either as a Member or a Visitor, any use of the APP shall be in compliance with all applicable laws wherever the User resides. It is understood that one may need to create an account to have access to certain parts of the Services. In consideration of the use of the Services:

      1. The User accepts and agrees to be bound by these Terms on condition that he/she has either reached the age of "majority" where he lives or his/her parent(s) or legal guardians agree to be constrained by these Terms on his/her behalf. If he/she does not know whether he has reached the age of majority where he/she lives, or does not understand this section, he/she is advised to ask his/her parent(s) or legal guardian(s) for help. In the cases where the User is a minor, his/her duties under this Agreement shall be extended to his/her parent(s) or his/her legal guardian(s).

      2. The User agrees not to use false, inaccurate, misleading information about himself/herself and his/her business when registering for his/her APP account (hereinafter the "Registration Data").

      3. The User shall maintain and promptly update the Registration Data to keep it true and accurate. If he/she provides any information that is untrue, inaccurate, misleading, or the APP has reasonable grounds to suspect that such information is false, inaccurate, or misleading, the Operator has the right to suspend or terminate the relevant account and refuse any and all current or future use of the APP (or any portion thereof).

      4. The User is responsible for the security and confidentiality of his/her password and account. Furthermore, he is responsible for all activity that occurs under his/her account unless he closes it down or reports misuse to the Operator. The User shall not share his/her account information, especially his/her user name and password, with any third party or permit any third party to login into the Services using his/her account. Any unauthorized use of an account or any other breach of security of which The User becomes aware shall be immediately notified to the Operator. The User is responsible for taking take precautions and take security measures best suited to the situation when he uses his/her account.

      5. If the User receives his/her Bridging News account from a third party, the third party may have additional rights over his/her account, such as the ability to access or delete the Content of the relevant account. The User is advised to review any additional terms the third party provided to the User, as the Operator does not take responsibility for these additional terms. If a Bridging News account has been created on behalf of an entity, such as the User's business or his/her employer, the User shall have the legal authority to bind that entity to these Terms.

    2. Closing an Account

      The APP service can be accessed to close an account. Upon closing an account, the use will lose immediate access to the APP. Second, Data or Content associated with the account will be deleted or otherwise disassociated from the User and the closed account (unless it is required by law that such content be kept, returned or transferred to the User or a third party identified by the User).

  7. User Submissions

    1. User Submissions

      While the APP encourages Members to submit comments, text, photos, images, audio, digital works, live streams, videos, and files in connection with the Services, and any related television programs and wireless and online broadcasts ("User Submissions" or "Submissions"), any such user submissions are deemed non-confidential and the Operator shall be under no obligation to maintain confidential any user submissions.

      Any User Submissions that include personal information will also be subject to Bridging News' Privacy Policy. The User promises that:

      1. He/she will only provide User Submissions which he/she has the right to share and submit;

      2. The User will only provide User Submissions that do not violate the law nor anyone's rights (including intellectual property rights);

    2. Inappropriate User Submissions

      The APP does not encourage or seek User Submissions that may cause any of the following happenings:

      1. May create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to the User, to any other person, or to any animal;

      2. May humiliate, assault or threaten other people (publicly or otherwise);

      3. May impersonate any other person or misrepresent the User's affiliation, title, or authority;

      4. May create a risk of any other loss or damage to any person or property; or

      5. May constitute a crime or a tort.

    3. Published User Submissions

      Published User Submissions, which are not controlled by the Operator, shall not represent the views of the Operator, its affiliates, or any individual associated with the Operator.

      In no event shall the User represent or suggest to represent, directly or indirectly, the Operator's endorsement of the published User Submissions. The Operator does not vouch for the accuracy or credibility of any published User Submissions on the APP, and does not take any responsibility or assume any liability for any actions the User may take as a result of reading published User Submissions on the APP. Through the use of the APP, the User can report to the Operator any published User Submissions that may be offensive, objectionable, harmful, inaccurate, or deceptive in order to enable the Operator to act in accordance with these Terms.

  8. Licenses by the Users to the Operator

    All the Uploaded Content, User Submissions, and Data that are provided by the Users to the APP are owned by the Users, unless their ownership or copyright is claimed by other parties. The Users shall grant the Operator and its affiliates a non-exclusive license. However, if the User has an agreement that includes an exclusive license to the Operator and its affiliates, that agreement shall govern.

    In addition to the non-exclusive license granted above, there is a worldwide, transferable and sub-licensable right to use, copy, modify, distribute, publish and process the Uploaded Content, User Submission, and Data that have been provided through the APP. The grant is given without any further consent, notice, and/or compensation to the User or a third party but:

    1. The User can end this license by deleting specific Uploaded Content, User Submissions, and Data provided by him/her from the APP, or generally by closing down his/her account, except (i) to the extent the Uploaded content, User Submission, and Data have been shared with other Users on the APP, and such other Users have already copied, re-shared and/or stored such Uploaded Content, User Submission and Data and (ii) for the reasonable time it takes to remove from backup and other systems;

    2. Users' Uploaded Content, User Submissions, and Data will not be included in advertisements for the products and services of third parties to others without separate consent from the relevant User. However, the Operator reserves the right, without payment to the User or third parties, to serve advertisements near your Content, Submissions, and Data;

    3. Consent will be obtained from the User if it is intended to give others the right to publish the User's Uploaded Content, User Submission, and Data beyond the APP;

    4. While the Operator may edit and make format changes to the User's Uploaded Content, User Submissions, and Data (such as translating or transcribing it, modifying the size, layout or file type or removing metadata), the core meaning of the expression shall not be modified;

    5. As the Operator is only entitled to a non-exclusive license, the User may choose to make the same type of license available to others.

  9. Prohibitions

    1. Code of Conduct

      By agreeing to these Terms, the User is agreeing that, when using the APP, he/she will follow these rules:

      1. Anything illegal is forbidden.

      2. He/she shall not engage in any activity that exploits, harms, or threatens to harm children.

      3. He/she shall not send spam or engage in phishing. Spam is unwanted or unsolicited bulk email, postings, contact requests, SMS (text messages), instant messages, or similar electronic communications. Phishing is sending emails or other electronic communications to fraudulently or unlawfully induce recipients to reveal personal or sensitive information, such as passwords, dates of birth, Social Security numbers, passport numbers, credit card information, financial information, or other sensitive information, or to gain access to accounts or records, exfiltration of documents or other sensitive information, payment and/or financial benefit.

      4. He/she shall not publicly display or use the APP to share inappropriate content or information that may violate the local law where he/she lives (involving, for example, nudity, bestiality, pornography, offensive language, graphic violence, or criminal activity).

      5. He/she shall not engage in activity that is fraudulent, false, or misleading (e.g., asking for money under false pretenses, impersonating someone else, manipulating the Services to increase play count, or affecting rankings, ratings, or comments).

      6. He/she shall not circumvent any restrictions on access to or availability of the Services.

      7. He/she shall not engage in activity that is harmful to the User himself/herself, the APP, or others (e.g., transmitting viruses, stalking, posting terrorist or violent extremist content, communicating hate speech, or advocating violence against others).

      8. He/she shall not infringe upon the rights of others (e.g., unauthorized sharing of copyrighted music, or other copyrighted material, resale or other distribution of photographs).

      9. He/she shall not engage in activity that violates the privacy of others.

      10. He/she shall not use any robot, spider, scraper, or other automated means to access the APP for any purpose without prior express written permission from the Operator.

      11. He/she shall not create or maintain any links to any pages of the APP on any other websites without prior written authorization from the Operator.

      12. He/she shall not run or display the APP or any Content of the APP in frames or through similar means on any other websites without prior written permission from the Operator.

      13. He/she shall not help others break these rules.

    2. Enforcement

      The User is solely responsible for his/her Uploaded Content, User Submissions and Data, and the APP does not have the obligation to prescreen any such Uploaded Content, User Submissions, or Data. To enforce these Terms, the Operator may suspend the User's access to the APP, stop providing services to such User, remove or refuse to publish the Uploaded Content or User Submissions, block delivery of a communication (like sharing or message) to or from the APP, or the Operator may close down the User account in the event that:

      1. There is a breach by the relevant User of these Terms;

      2. It is unable to verify or authenticate any information the User provides to the APP or the Operator;

      3. It is the belief of the Operator that the actions of the relevant User may cause or have caused financial loss or legal liability for the User himself/herself, the Users of the APP, the Operator, or its affiliates.

      Except as disclosed in the Privacy Policy, the Operator will not monitor, edit, or disclose the Uploaded Content, User Submissions, and Data provided by the User unless required in the course of normal maintenance of the APP and its systems or required to do so by law or in the good-faith belief that such monitoring, editing, or disclosure is necessary to:

      1. Comply with the law or comply with the legal process served on the Operator or on the APP;

      2. Protect and defend the rights or property of the APP, the Operator and the Users of the APP;

      3. Act in an emergency to protect the personal safety of employees of the Operator or the public.

    It is impossible for the Operator to monitor the entire APP, and the Operator has no intention of doing so. However, when investigating alleged violations of these Terms, the Operator reserves the right to review the Uploaded Content, User Submissions, and Data in order to resolve the issue, and the Operator will also fully cooperate with law enforcement authorities and follow court orders, and subpoenas.

  10. Third Party Services

    According to needs for operation, the APP may allow the User to access or acquire products, services, websites, links, content, material, games, skills, integrations, bots, or applications from independent third parties that are not owned, operated or controlled by the Operator or its affiliates (hereinafter the "Third-Party Services"). All such Third-Party Services are provided solely as a convenience to the User. If the User chooses to use Third-Party Services, he/she will leave the APP. Neither the Operator nor any of its affiliates are responsible for any content, materials or other information located on or accessible from Third-Party Services, or the results that he/she may obtain from using Third-Party Services. The User should review the third-party terms and privacy policies before acquiring, using, requesting, or linking his/her account to any Third-Party Services. No third-party terms shall modify any of these Terms. The User shall be responsible for his/her dealings with third parties. No license on any intellectual property of the APP or of the Operator will be given to the User for him/her to use any part of any Third-Party Services. The Operator is not responsible or liable to the User or others for information or services provided by any Third-Party Services.

  11. Disclaimers and Limited Liability

    1. No Warranty

      The User should understand that the use of the APP is at his/her own risk. The Operator does not guarantee continuous, uninterrupted, or secure access to the APP. He/she also understands that the operation of the APP may be interfered with by numerous factors beyond the control of the Operator. The contents provided on or through the APP shall be provided as an "as is" status, without any warranties of any kind from the Operator. Neither the Operator nor its affiliates will warrant the accuracy or completeness of the services or the content displayed on the APP. The services and the content provided by the APP may be out of date and neither the Operator nor its affiliates will make any commitment or assume any duty to update such services or content. No advice or information, whether oral or written, obtained from the Operator or from the APP through the content provided therein shall constitute any warranty of the Operator unless expressly made therein, unless the governing law otherwise requires it.

    2. Limited Liability

      The Operator and its affiliates do not assume any responsibility and will not be liable for any damages to, or any viruses that may infect the User's computer or telecommunication equipment or other property caused by or arising from his/her access to or use of the APP or during his/her downloading from the APP.

      In no event will the Operator or any of its officers, directors, employees, shareholders, affiliates, agents, successors, or assigns, or any party involved in the creation, production, or transmission of the APP be liable to the User or anyone else for any indirect, special, punitive, incidental or consequential damages (including without limitation, those resulting from lost profits, lost data or business interruption) arising out of the use of, or inability to use, the APP, or the content on the APP, whether based on warranty, contracts, or torts or any other legal theory and whether or not advised of the possibility of such damages.

      The User shall specifically acknowledge that the Operator shall not be liable for the content, the submission, data, or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with the User, unless it is otherwise required by the governing law.

      In the event of any problem with the APP or any content on the APP, it is agreed that the sole remedy for the User is to cease using the APP. In no event shall the Operator be liable to the User for any damages, losses, and causes of action whether in contract, or tort (including, but not limited to, negligence.)

    3. Indemnity

      The User agrees to defend, indemnify and hold the Operator and its affiliates or individuals harmless from any liabilities, costs, and expenses, including reasonable attorneys' fees, in connection with:

      1. Access or Use of the APP by the User or other users authorized by him/her;

      2. The User's violation of any of these Terms;

      3. The User's violation of any third party's rights, including without limitation, any right of privacy, publicity rights, or intellectual property rights;

      4. The User's violation of any law, rule or regulation of the People's Republic of China or any other country he/she presently resides in;

      5. Any claim or damages that arise as a result of any Uploaded Content, User Submissions, and Data that the User provides to the APP; and/or

      6. Any third party accessing and using of the APP with the User's unique username, password or other appropriate security code.

    4. Release

      In the event that the User has a dispute with one or more other users of the APP, the User agrees to release the Operator (and its officers, directors, agents, affiliates, joint ventures, and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known or unknown, suspected and unsuspected, disclosed or undisclosed, arising out of or in any way connected with such dispute.

  12. Miscellaneous

    1. Force Majeure

      Neither the Operator nor the User shall be responsible for damages, delays, or failures in performance resulting from acts or occurrences beyond their reasonable control, including, without limitation: fire, lightning, explosion, power surge or failure, water, pandemic, war, revolution, civil commotion or acts of civil or military authorities or public enemies; any law, order, regulation, ordinance, or requirement of any government or any representative of any such government; labor unrest, including without limitation, strikes, slowdowns, picketing, or boycotts.

    2. Governing Law and Dispute Resolution

      The Operator and the User agree that any disputes relating to these Terms and the APP shall be governed by the laws of the People's Republic of China. The User consents to the exclusive jurisdiction of any proper people's court with jurisdiction located in Chongqing, P. R. China.

    3. Entire Agreement

      These Terms are the entire agreement between the User and the Operator. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be removed, and the remaining provisions shall be enforced. The User agrees that these Terms and all incorporated agreements shall be interpreted by the Operator in its sole discretion. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Any failure to act with respect to a breach by the User or others does not mean the Operator has waived its right to act with respect to subsequent or similar breaches. These Terms set forth the entire understanding and agreement between the Operator and the User with respect to the subject matter hereof.

    4. Sections to Survive Termination

      Sections 9 (Prohibitions), 11 (Disclaimer and Limit of Liability), and 12 (Miscellaneous) shall survive any termination or expiration of these Terms.

  13. Intellectual Property Complaints & Notices

    1. Intellectual Property Complaints

      The Operator has in place certain legally mandated procedures regarding allegations of copyright infringement occurring on the Services. A policy has been adopted that provides for the immediate suspension or removal of any content that violates the intellectual property rights or other rights of the Operator or any third parties. For complaints concerning any Uploaded Content, User Submissions, or Data on the APP, the User may contact the Operator by sending his/her complaints to the office address provided in Section 14, containing the following:

      1. A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest and proof of the authorized person's identification;

      2. Any evidence or proof to identify the copyrighted work or other intellectual property that has been claimed to be infringed;

      3. Any evidence or proof to identify the material on the APP that has been claimed to be infringing, with enough details so that it can be located on the APP;

      4. A statement by the User that he/she has a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

      5. A statement by the User declaring that the above information in the User's complaint is true and accurate;

      6. The User's name, physical address, telephone number, email address, and other contact information;

    2. Intellectual Property Notices

      An infringement notice of intellectual property rights may be given to APP users by means of a general notice on the APP, or by means of emails to the user's email address in registration data, or by means of written communication sent by first-class mail to the user's physical address. If the User receives such an infringement notice, the User shall provide counter-notification to the office address provided in Section 14. To be effective, the counter-notification must be in written and contain the following:

      1. A proof of the User's identification and his/her physical or electronic signature;

      2. Identification of the Content, Submission, or Data that has been removed or suspended or to which access has been disabled and the location at which the Content, Submission, or Data appeared before it was removed or suspended;

      3. A statement from the User that he/she has a good faith belief that the material was removed or suspended as a result of a mistake or misidentification;

      4. The User's name, physical address, telephone number, email address, and other contact information.

  14. Notices and Contact Information

    If the User does not understand any of the foregoing Terms, or if he/she has any other general inquiries, he/she may contact the Operator via service@ichongqing.info.

      请注意,您一旦点击APP之打开页面上的"同意"按钮则意味着您接受协议条款,并愿意与运营商达成具有法律约束力的协议(即使您代表公司或实体使用亦是如此)。 如果您不同意这些条款,请不要点击"同意",不再使用应用APP并立即退出。 如果您希望终止本协议,您可以随时通过关闭您的帐户并且不再访问或使用APP以便终止本协议。

    3. 协议条款变更

      这些条款可能会根据需要进行变更。如果发生重大变更,我们将通过 APP或其他方式向用户发出通知,让用户有机会在变更生效前对其进行阅览。

      我们假定条款的变更均不具有溯及力。变更公告发出,或者用户收到变更通知后,用户继续使用该APP的,则意味着他/她接受这些更改。用户不同意变更的,他/她只能关闭他/她的帐户或停止使用APP。

  2. 隐私政策

    用户应仔细阅读 Bridging News 隐私政策 (https://bn.ichongqing.info/protocol/privacy.html),隐私政策构成协议条款的组成部分。他们规定了APP如何收集关于用户及其设备的数据(以下简称"数据")、数据的使用方式以及他们所适用的法律。隐私政策还规定了如何处理用户上传的内容,例如用户与他人的通信中包含的内容、他们的帖子,他们上传、存储、广播或共享的文件、照片、文档、音频、数字作品、网络直播内容、视频等(以下简称"上传内容")。上传内容的处理将在征得用户同意后依法处理。用户同意协议条款,将视为已同意 APP 收集、使用和披露隐私政策中所述的上传内容和数据。若情况要求,将会单独向用户发出通知,征求其同意。

  3. 版权和所有权

    用户享有上传内容的所有权和版权,除非第三方就相同内容主张所有权和/或版权。

    上传内容之外的其他内容的所有权和版权,则归运营商、其关联方、其许可方、供应商、代理人和/或其内容提供商所有。

    与APP 相关的任何非内容知识产权的所有权和版权归运营商、其关联方,其许可方、供应商、代理和/或其服务提供商所有。

    用户在此同意,运营商、其关联方、其许可方、供应商、代理人及其服务提供商有权出于向用户提供服务之目的或者出于协助或者技术上支持向用户提供服务之目的使用上传内容。

    除非在APP中另有特定文件加以说明,或出现所适用的当地版权法允许的情况,用户

    1. 在此被授权查看、播放、打印和下载在应用程序中找到的受版权保护的内容,只能用于个人目的、求知目的等非商业目的。 同时,禁止对APP、上传内容、以及上传内容以外的其它内容进行任何转售或出于商业目的进行使用;

    2. 不得修改、复制、分发、传输、展示、执行、复制、发布、许可、转让、出售或创建应用程序中包含的任何内容的衍生作品;

    3. 在重新使用APP中提供的任何受版权保护的内容之前,应事先获得书面许可;

    4. 不得从应用程序的内容中删除任何版权或其他所有权的通知。

  4. 商标

    在协议条款中使用并包含在 APP 中的运营商的所有商标、服务标志和商品名称(统称“标识”),指运营商或其关联方、合作伙伴、供应商或许可方的商标或注册商标。未经运营商事先书面同意,用户不得以任何方式,尤其是在广告、演示或促销中,使用、复制、重作、上传、发布、传输、分发或修改它们。

    用户不得在在任何其他网站或应用程序上使用这些标标识。禁止将“标识”设置为“热”链接,事先获批者除外。未经事先书面同意,用户不得其使用的任何语言表达、图片展示或者符号中使用“Bridging News”的名称。这是因为在运营商看来,用户以用书面方式或者在口头广告或演示文稿中使用该名称或者在宣传册、报纸、书籍或其他任何性质的书面材料中使用该名称,可能会让人误以为运营商已经同意在前述情形下使用该名称。

  5. 服务的可用性

    因为该APP不提供存储服务,所以运营商即使可能更改、暂停或终止APP或其任何部分,不承诺存储或持续展示用户分享或提交给APP的任何内容。双方同意,除非适用的法律如此要求,或者APP内含文件中另有说明的,运营商没有义务存储或维护用户上传内容,也无义务向用户提供用户上传内容的副本。

    未经运营商事先书面同意,用户不得:

    1. 在 APP 上使用数据挖掘、机器人或类似的数据收集和提取工具;

    2. 勾勒或利用勾勒技术来封装运营商、内容提供商或其关联方的任何商标、徽标或其他专有信息(包括图像、文本、页面布局或表格);

    3. 使用任何使用运营商名称或商标的元标签或任何其他“隐藏文本”;

    4. 采取任何对APP基础设施施加或可能施加在运营商看来会给基础设施带来不合理或不成比例的大量负载的行为;

    5. 干扰或试图干扰APP的正常运行或APP上进行的任何活动;

    6. 绕过任何旨在阻止或限制访问APP的措施;

    如果发生任何未经授权的使用,运营商有权暂停或阻止用户访问APP(或其任何部分)。

  6. 使用APP

    1. 账户注册

      作为成员或访客,无论用户居住在何处,其对APP的任何使用均应遵守所适用法律。双方明白,有时,需要创建一个帐户才能使用APP的某些功能。作为使用运营商服务的对价:

      1. 如果用户已经是其居住地认为的成年人,用户应接受并同意受本协议条款的约束。如果用户没有成年,则由他/她的父母或法定监护人代为同意接受这些条款的约束。 如果他/她不知道自己是否已达到居住地的成年年龄,或不理解本节,建议他向他/她的父母或法定监护人寻求帮助。如果用户是未成年人,则其在本协议项下的职责应扩大至对其父母或其法定监护人具有约束力。

      2. 用户同意在注册其APP账户时不使用虚假、不准确、误导性的有关自己和业务的信息(以下简称“注册数据”)。

      3. 用户应维护并及时更新注册数据以保持其真实和准确。如其提供任何不真实、不准确或具有误导性的信息,或APP有合理理由怀疑该等信息为虚假、不准确或具有误导性的,则运营商有权暂停或关停相关账户并拒绝任何当前或未来对APP(或其任何部分)的使用。

      4. 用户对其密码和账户的安全和保密负责。此外,他应对其帐户下发生的所有活动负责,除非他将其关闭或者他向运营商报告滥用行为。用户不得与任何第三方共享其账户信息,特别是用户名和密码。更不得允许任何第三方使用其账户登录服务。用户一旦得知发生任何账户的盗用行为或者任何其他违反安全性的行为,都应立即通知运营商。用户有责任在使用他/她的帐户时采取预防措施,并采取在当时看来最好的安全措施。

      5. 如果用户从第三方收到他/她的Bridging News帐户,则第三方可能对其帐户拥有额外的权利,例如访问或删除相关帐户内容的能力。建议用户查看第三方提供给用户的任何附加条款,因为运营商对这些附加条款不承担任何责任。如果用户已代表某个实体(例如用户的企业或其雇主)创建了 Bridging News 帐户,则用户应具有使该实体受这些条款约束的法律授权。

    2. 关闭账户

      用户可以联系APP服务关闭账户。同意关闭账户将导致立即失去对APP的访问权限。另外,与账户相关的数据或内容将被删除或者因为其它原因与用户和关闭的账户解除关联关系(除非法律要求保留、退回或转移此类内容给用户或用户指定的第三方)。

      用户同意,如果任何用户提交的内容包含个人信息,他们也应遵守 Bridging News的隐私政策,并承诺:

      1. 他/她只会提供他/她有权分享和提交的用户上传内容;

      2. 用户提供之上传内容不会违反法律或侵害他人权利(包括知识产权)。

    3. 用户上传内容不当

      APP 反对任何可能导致以下任一结果的用户上传内容:

      1. 该内容可能对用户、任何其他人或任何动物造成伤害、损失、身体或精神伤害、情绪困扰、死亡、残疾、毁容或带来身体或精神疾病;

      2. 该内容可能(以公开或以其他方式)对他人构成羞辱、攻击或威胁;

      3. 该内容可能构成对他人的身份冒充或者对用户的从属关系、头衔或权限的歪曲;

      4. 该内容可能带来对任何人或财产造成任何其他损失风险或损害风险;

      5. 该内容可能构成犯罪或侵权。

      用户同意,他/她没有参与也不会参与与制作他/她所上传的内容有关的任何上述活动。一旦运营商认为用户有参与上述任何活动的行为,运营商保留拒绝和删除 用户的上传内容的权利。

    4. 用户上传的内容

      用户在APP上传并发布的内容,由于不受运营商控制,将不代表运营商、其关联方或与运营商相关的任何其他方的观点。

      在任何情况下,用户均不得直接或间接地以明示方式或暗示方式向他人宣称,运营商已经认可其上传之内容。 就用户在 APP 上传之内容,运营商不对其准确性或可信度进行保证,更不会对用户在阅读 APP上发布的用户提交内容后可能采取的任何行动承担任何责任。通过使用 APP,用户若在APP上发现,有令人反感的、有害的、不准确的或具有欺骗性的用户上传内容,他/她可向运营商报告,以使运营商能够根据这些条款作出相应的反应。

  7. 用户对运营商的许可

    用户之上传内容、用户提交之其它内容和数据均归用户所有,除非有其他方主张其所有权或版权。用户应授予运营商及其关联方非独家许可使用权。但是,如果用户另有协议,已经给予了对运营商及其关联方的独家许可,则以该协议为准。

    上述的非独家许可使用权包括在全球范围内使用、复制、修改、分发、发布和处理已通过 APP 提供的上传内容、用户提交和数据的可转让和再许可的权利。非独家使用权无需来自用户的任何进一步同意、通知,无需对用户或者第三方进行补偿。但是:

    1. 用户可以通过从APP中删除他/她提供的特定上传内容、其它内容和数据,或通过关闭他/她的帐户来终止本许可。即便如此,也应该考虑到下列两种情形,一是在上传内容的范围内,用户提交的内容和数据已在 APP 上与其他用户共享,此类其他用户又已经复制、重新共享和/或存储了此类上传的内容、其它内容和数据,二是需要合理时间,来从 APP 中删除备份和其他系统;

    2. 未经相关用户的单独同意,用户上传的内容、用户提交的其它内容和数据不会包含在第三方的产品和服务的广告中。但是,运营商保留在用户上传之内容、提交内容和数据附近投放广告的权利,且该等投放,无需向用户或第三方付款。

    3. 运营商在授予第三方在APP以外发布用户上传内容、用户提交的其它内容和数据的权利前,将需要征得相关用户的同意;

    4. 虽然运营商可以对用户上传的内容、用户提交的其它内容和数据进行编辑和格式更改(例如翻译或转录,尺寸调整、布局或文件类型或删除元数据),但运营商不会修改用户内容的核心含义;

    5. 由于运营商获得之q使用权为非独家许可,用户可以选择向其人提供相同类型的许可。

  8. 禁止行为

    1. 行为准则

      用户同意了这些条款,则表明他/她同意,在使用本APP时,他/她将遵守以下规则:

      1. 禁止任何违法行为。

      2. 不得从事任何压榨、伤害或威胁伤害儿童的活动。

      3. 不得发送垃圾邮件或从事网络钓鱼。垃圾邮件包括不需要的或不请自来的批量电子邮件、帖子、联系请求、SMS(文本消息)、即时消息或类似的电子通信等。网络钓鱼包括向他人发送电子邮件或其他电子通信以欺诈或非法诱使收件人透露个人或敏感信息,例如密码、出生日期、社会安全号码、护照号码、信用卡信息、财务信息或其他敏感信息,或访问账户或记录、保密文件或其他敏感信息、付款和/或经济利益。

      4. 不得公开展示或使用APP分享可能违反其居住地当地法律的不当内容或信息(例如,涉及裸体、兽交、色情、攻击性语言、图形暴力或犯罪活动)。

      5. 不得从事欺诈、虚假或误导性活动(例如,以虚假借口索取金钱、冒充他人、操纵服务以增加游戏次数,或影响排名、评级或评论)。

      6. 不得规避APP采取的对服务访问或可用性进行限制的任何措施。

      7. 不得从事对用户本人、APP或他人有害的活动(如传播病毒、跟踪他人、发布恐怖主义或暴力极端主义内容、传播仇恨言论或宣扬对他人的暴力行为) )。

      8. 不得侵犯他人的权利(例如,未经授权共享受版权保护的音乐或其他受版权保护的材料、转售或以其他方式分发照片)。

      9. 不得从事侵犯他人隐私的活动。

      10. 未经运营商事先明确书面许可,不得出于任何目的使用任何机器人、蜘蛛软件、爬虫软件或其他自动化手段访问应用程序。

      11. 未经运营商事先书面许可,不得在APP任何页面的任何其他网站上创建或维护任何链接。

      12. 未经运营商事先书面许可,他/她不得在任何其他网站上以框架或类似方式运行或展示应用程序或应用程序的任何内容。

      13. 不得帮助他人违反上述禁止性这些条款。

    2. 执行

      用户对其上传的内容、用户提交的其它内容和数据以及应用程序负全部责任,运营商其有权但无义务预先筛选任何此类上传的内容、用户提交的内容或数据。为了执行这些条款,出现下列情况时,运营商可以暂停用户对 APP的访问,停止向此类用户提供服务,删除或拒绝发布用户上传的内容或用户提交的内容,阻止其与APP的交流,还可以关闭用户帐户:

      1. 相关用户违反了这些条款;

      2. APP无法对用户提供给APP或运营商的任何信息进行验证或认证;

      3. 运营商认为相关用户的行为可能为或已经为用户本人、其它APP用户、运营商或其关联方带来经济损失或法律责任。

      除在隐私政策中已经说明的情况外,运营商不会监控、编辑或披露用户提供的上传内容、用户提交的其它内容和数据。出于对 APP 及其系统的正常维护,根据法律规定,运营商真诚地相信,为完成下列事项,有必要进行此类监控、编辑或披露:

      1. 运营商需要遵守法律或遵守运营商收到的法院指令;

      2. 运营商需要保护和捍卫APP、运营商、APP用户的权利或财产;

      3. 运营商在紧急情况下需要采取行动保护其员工或公众的人身安全。

    运营商不可能监控整个APP,也无意这样做。但是,在调查涉嫌违反这些条款的行为时,运营商保留审查用户上传的内容、用户提交的其它内容和数据以解决问题的权利,并且运营商还将全力配合执法部门并遵守的法院指示和传票命令。

  9. 第三方服务

    根据需要,APP 可能会允许用户访问或获取非运营商拥有、运营或控制的独立第三方的产品、服务、网站、链接、内容、材料、游戏、技能、集成、机器人或应用程序(以下简称“第三方服务”)。运营商或其关联方仅出于方便用户之目的提供此类第三方服务。如果用户选择使用第三方服务,他/她将离开APP。运营商或其任何关联方均不对位于第三方服务上或可在第三方服务访问到的任何内容、材料或其他信息,或他/她使用第三方服务可能获得的结果负责。用户在获取、使用、请求或将其帐户链接到任何第三方服务之前,应查看第三方之协议条款和其隐私政策。第三方条款均不得修改任何本协议条款。用户应对其与第三方的交易负责。 在使用APP时,用户得到了APP 或运营商的任何关于知识产权的授权。但他/她在使用第三方服务时,该授权则不适用。 运营商不对用户或其他人的信息或由第三方提供的服务承担责任。

  10. 免责声明和有限责任

    1. 无保证

      用户应明白,使用该APP的风险由他/她自己承担。运营商不保证用户能持续、不间断且安全地访问 APP 。他/她也明白,APP的运行可能会受到运营商无法控制的众多因素的干扰。在 APP上呈现的或用户能通过 APP获得的内容都是按"原样"状态提供,运营商不提供任何形式的保证。运营商及其关联方均不保证在APP上提供的服务或内容的准确性或完整性。 APP提供的服务和内容可能已经过时,运营商及其关联方均不对此类服务或内容的更新做出任何承诺或承担任何责任。就APP提供的内容而言,用户从运营商或 APP 获得的任何口头或书面建议或信息均不构成运营商的任何保证。运营商或APP内含文件中有明确规定的,或法律另有要求者除外。

    2. 责任限制

      用户使用APP进行下载时,用户访问APP或使用APP时,可能会导致或产生损害,可能会感染用户计算机或电信设备或其他财产的任何病毒。为此,运营商及其关联方不承担任何责任。

      在任何情况下,运营商或其任何管理人员、董事、雇员、股东、关联方、代理人、权利承继方或权利受让人,或参与创建、制作或传输 APP 的任何一方均不对用户或其他任何人因使用、无法使用本APP或APP内容而引起的任何间接、特殊、惩罚性、附带或后果性损害(包括但不限于因利润损失、数据丢失或业务中断而造成的损害)向用户或该其他任何人承担责任,无论该责任是基于保证行为、还是基于合同义务、基于侵权行为或基于任何其他法律理论,或者是基于未履行就此类损害发生可能性的告知义务的不作为。

      用户在此明确承认,运营商不对任何第三方的内容、提交、数据或诽谤、冒犯或非法行为向用户承担责任,并且上述损害或损害的风险完全由用户承担,除非适用法律另有规定。

      如果APP或APP上的任何内容出现任何问题,用户同意其唯一能够采取的救济措施就是停止使用APP。在任何情况下,运营商均不对用户的任何损害、损失和诉由承担责任,无论是合同行为还是侵权行为(包括但不限于疏忽)。

    3. 赔偿

      用户同意为运营商及其关联方或个人进行辩解,并赔偿运营商及其关联方或个人因下列事项引发的任何责任、成本和费用,包括合理的律师费:

      1. 用户或其授权的其他用户访问或使用本APP;

      2. 用户违反任何本协议条款;

      3. 用户侵犯任何第三方的权利,包括但不限于任何隐私权、公开权或知识产权;

      4. 用户违反中华人民共和国或他/她目前居住的任何其他国家的任何法律、法规或规章;

      5. 因用户向APP提供的任何上传内容、用户提交其他内容和数据而产生的任何索赔或损害;

      6. 任何第三方通过用户的唯一用户名、密码或其他适当的安全代码访问和使用 APP。

    4. 发布

      如果用户与APP的一名或多名其他用户发生纠纷,用户同意不向运营商(及其管理人员、董事、代理人、关联方、合资企业和员工)提出索赔、要求和任何类型和性质的损害补偿,包括直接的或者间接的,已知的或未知的,已经有所怀疑的和或事前并无怀疑的,披露的或未披露的,以及由此类争议引发或以任何方式与之相关的。

  11. 其它

    1. 不可抗力

      运营商和用户均不对由于超出其合理控制范围的行为或事件(包括但不限于:火灾、闪电、爆炸、电涌或故障、水、流行病、战争、革命、内乱或民事或军事当局或公敌的行为;任何政府或任何此类政府的任何代表的任何法律、命令、法规、条例或要求;劳工骚乱,包括但不限于罢工、放缓、纠察或抵制)承担责任。

    2. 适用法律和争议解决

      运营商和用户同意,与本协议条款和APP有关的任何争议均适用中华人民共和国法律。发生诉讼争议时,用户同意提交位于中国重庆的任何具有管辖权的适当人民法院进行处理。

    3. 完整协议

      本协议“条款”是用户与运营商之间的完整协议。如果本条款的任何规定被认定为无效或不可执行,则应删除该规定,并执行其余规定。 用户同意,这些条款和所有后来并入的协议应由运营商自行决定解释。标题仅供参考,无意定义、无意限制、无意解释或无意描述其项下条款内容的范围或程度。运营商没有针对用户或其他人的违规行为采取行动不意味着运营商已放弃其对后续或类似违规行为采取行动的权利。协议"条款"构成了运营商和用户之间关于本协议标的的全部理解和协议。

    4. 协议终止依然有效的部分

      第 9 条(禁止)、第 11 条(免责声明和责任限制)、第 12 条(其他)在本条款终止或到期后仍然有效。

  12. 知识产权投诉和通知

    1. 知识产权投诉

      运营商制订了一些程序,以期解决在APP上发生的版权侵权指控制。其中有一条政策规定,发现任何侵犯运营商或任何第三方的知识产权或其他权利的内容,该内容将被立即删除。针对任何关于APP上的上传内容、用户提交的其它内容或数据的投诉,用户可以将其他/她的投诉发送到第14条中提供的办公地址来联系运营商,投诉内容应包含以下内容:

      1. 含有版权所有人的纸质签名或者电子签名的授权代理人代表其行事的授权文件以及代理人的身份证明;

      2. 版权作品或其他知识产权被侵权的证据;

      3. 能够在APP上发现的,证明权利在APP上被侵犯的证据;

      4. 用户做出的说明他/她有充分理由相信其所投诉的使用属于未经版权所有者、其代理人或法律授权的使用的声明;

      5. 用户关于其投诉所包含的信息真实准确的声明;

      6. 进行投诉用户的姓名、实际地址、电话号码、电子邮件地址和其他联系信息。

    2. 知识产权声明

      运营商发出的知识产权侵权通知可以是通过APP发出的普通通知,也可以是通过电子邮件发送至用户注册数据中的电子邮件地址的电子邮件通知,还可以是以书面形式通过一等邮件发送至用户的物理地址的信函通知。如果用户收到此类侵权通知,用户应向第 14 条提供的办公地址提供反通知。反通知必须采用书面形式方为有效。反通知应包含以下内容:

      1. 用户身份证明和他/她的物理签名或电子签名;

      2. 用户上传内容或提交其它内容或数据已经被禁用、被拒绝访问、被暂停或者被删除的证据,以及该上传内容、提交的其它内容或数据在删除或者暂停之前出现在APP上的位置;

      3. 用户表明他/她有充分的理由相信该材料因错误或错误识别而被删除或暂停的声明;

      4. 用户的姓名、实际地址、电话号码、电子邮件地址和其他联系信息。

  13. 通知和联系信息

    如果用户不理解上述任何条款,或者如果他/她有任何其他一般性咨询,他/她可以通过service@ichongqing.info联系运营商。
